Data Sharing Requirements

Introduction

Through AppLovin’s services, including Axon Ads Manager and MAX, we aim to create a safe and positive experience for all users. Our Privacy Policy,  Terms of Use Agreement, and Policies for Publishers or Policies for Demand Partners (as applicable) (the “Terms and Policies”) set clear rules for content and data practices.  

Before using AppLovin’s services or installing any SDK, pixel or cookies, API, script, or other integrations in connection with AppLovin’s services, you must first review these Terms and Policies, understand your responsibilities when collecting, using, or sharing user data with AppLovin, and ensure your integrations comply with them. 

This page highlights key compliance obligations from the Terms and Policies and serves to remind you of the requirements related to privacy, transparency, user consent, and the proper handling of user data.

General Data Sharing Requirements

Before you install any SDK, pixel or cookies, API, script, or other integrations in connection with AppLovin’s services (“Software”) or share any user data with AppLovin, you must:

➔ Review and abide by AppLovin’s Privacy Policy,  Terms of Use Agreement, and Policies for Publishers or Policies for Demand Partners as applicable.

➔ Be sure that you comply with all applicable laws, rules, and regulations relating to the collection, use, and sharing of information about any end user who interacts with AppLovin’s services.

➔  Be sure that your privacy policy cleary discloses your collection, use, and sharing of data with third parties for advertising purposes. Specifically, it must list AppLovin as such a third party and include: “For more information about AppLovin’s collection and use of your information visit: https://legal.applovin.com/privacy/.”

➔  Be sure that your privacy policy is easily accessible from your apps or properties (including in the footer section of your website).  

➔ Ensure that you comply with data and other limitations applicable to your use of AppLovin’s services, as described in the relevant technical integration documentation in Axon support center and any other instructions we provide. 

➔ Ensure (where required by law) that each end user consents to the storing or accessing of cookies, device-specific information, or other information on their device in connection with AppLovin’s services prior to storing, accessing, or sharing that information with AppLovin, and upon AppLovin’s request, provide us with written evidence of such consent, including the date of the consent and the consent language presented to the end user.

➔ Ensure that you have adequate rights and have obtained all necessary permissions and consents required under applicable laws to disclose user data to AppLovin for purposes consistent with the Terms and Policies, including improving the services.

➔ Ensure that you will make available, maintain, and make operational on your properties: (i) a mechanism for obtaining such consent from end users; and (ii) a mechanism to honor end users’ data subject rights (opt-out of sale for interest-based advertising, deletion, access, etc.). You will implement processes to pass these signals to AppLovin where required.

Specific to Web Advertisers: Implement a compliant cookie banner (or comparable mechanism), disclose your usage of the Software, and respect end user consent choices as required under applicable laws. 

Prohibition on Using the Services in Connection with “Children” or Apps Exclusively Targeted to “Children”

➔ Ensure that you will not – directly or indirectly via a third party – provide any “children” data to AppLovin or use AppLovin’s services in connection with a “child” as defined under applicable laws.

➔ Ensure that you will not initialize or use in any way any Software in connection with a “child” as defined under applicable laws.

➔ Ensure that you will not use AppLovin’s services in connection with any digital property or advertisement exclusively designed for or exclusively directed to “children” as defined under applicable laws, or for any end user or advertisement that could implicate the Children’s Online Privacy Protection Act of 1998, 15 U.S.C. 6501, et seq. (“COPPA”), other age-related laws in any applicable jurisdiction, and any applicable app store (or platform) policies. 

Prohibition on Sensitive Personal Data or PHI

➔ Ensure that you will not provide or use AppLovin’s services to collect, share, process, or infer any sensitive personal data or protected health information as defined under applicable laws.

➔ Ensure that you do not pass any custom data fields, events, or objects that could include sensitive personal data or protected health information.
