Introduction
Through AppLovin’s Services*, including AppLovin Ads and AppLovin Max, we aim to create a safe and positive experience for all users. Our Privacy Policy, Terms of Use Agreement, and Policies for Publishers or Policies for Demand Partners (as applicable) (the “Terms and Policies”) set clear rules for content, privacy, and data practices.
This page highlights key compliance obligations from the Terms and Policies including requirements related to privacy, transparency, user consent, and the proper handling of user data. The requirements listed below help to facilitate compliance, but legal requirements extend beyond these. You should solicit your own legal advice to determine how legal requirements apply to you.
General Data Sharing Requirements
Before using AppLovin’s Services, installing any SDK, pixel or cookies, API, script, or other integrations in connection with AppLovin’s Services (the “Software”), and/or sharing any user data with AppLovin, you must:
• Review and abide by AppLovin’s Privacy Policy, Terms of Use Agreement, and Policies for Publishers or Policies for Demand Partners as applicable.
• Comply with all applicable laws, rules, and regulations relating to the collection, use, and sharing of information about any end user who interacts with AppLovin’s Services.
Privacy Policy
• Your privacy policy must clearly disclose your collection, use, and sharing of data with third parties for advertising purposes. Specifically, it must list AppLovin as such a third party and include: “For more information about AppLovin’s collection and use of your information visit: https://legal.applovin.com/privacy/.”
• Your privacy policy must be easily accessible from your Properties (including in your apps and in the footer section of your website).
Notice and Consent
• You must have adequate rights, provide visible notice to end users, and obtain all necessary permissions and consents required under applicable laws. Where necessary, you must obtain a valid, specific, and informed consent from end users – regarding the scope of collection, use, sharing, or other processing of data by AppLovin for advertising and related purposes (including serving interest-based advertising and improving the Services, including our AI-powered technologies) – prior to the collection, use, sharing, or other processing of such data by AppLovin, as described in AppLovin’s Privacy Policy.
• Upon AppLovin’s request, provide AppLovin with evidence of such consent, including the date of the consent and the consent language presented to the end user.
Cookie Banners (specific to Web Advertisers)
• If you enable AppLovin’s pixel, cookies, API, script, or other integrations on your website, you must also implement a cookie banner (or comparable mechanism) that discloses that enablement, identifies AppLovin and the relevant technologies deployed on your website, collects and respects users’ consent choices concerning those technologies, and otherwise complies with applicable laws.
Privacy Choices and Opt-Out Rights
• Respect all end user- or device-based privacy choices or flags made known to you.
• Make available, maintain, and make operational on your Properties: (i) a mechanism for obtaining consent from end users; and (ii) a mechanism to honor end users’ data subject rights (opt-out of sale for interest-based advertising, deletion, access, etc.).
• Implement processes to pass consent signals to AppLovin as required by applicable laws and the AppLovin Terms of Use Agreement.
Privacy and Data Security Obligations
• Do not collect or use any data received through the Services for purposes other than those set out in the Terms and Policies or in any other policy or agreement governing your access to or use of the Services.
• Implement adequate technical, security, and organizational measures to protect any data from loss and misuse, as well as any unauthorized access, disclosure, alteration, and destruction.
• Comply with data and other limitations applicable to your use of AppLovin’s Services, as described in the relevant technical integration documentation in the AppLovin Support Center and any other instructions we provide.
• Provide a way for individuals to contact you with inquiries and requests regarding their personal data.
Prohibition on Sensitive Personal Data or Protected Health Information
• You may not use AppLovin’s Services to infer, collect, track, send, share, identify, or associate with any individual, household, or device any sensitive personal data or protected health information as defined under the Terms and Policies and applicable laws.
• You may not pass to AppLovin any custom data fields, events, or objects that could include sensitive personal data or protected health information.
• You may not use any feature or functionality of AppLovin’s Services to select, build, or target personalized ads using sensitive personal data or protected health information.
Prohibition on Using the Services in Connection with “Children” or Apps Exclusively Targeted to “Children”
• You may not – directly or indirectly via a third party – provide any “children” data to AppLovin or initialize or use in any way AppLovin’s Services in connection with a “child” as defined under applicable laws.
• You may not use AppLovin’s Services in connection with any Property or Advertisement exclusively designed for or exclusively directed to “children” as defined under applicable laws, or for any end user or Advertisement that could implicate the Children’s Online Privacy Protection Act of 1998, 15 U.S.C. 6501, et seq. (“COPPA”), similar laws that govern the privacy of “children” in any applicable jurisdiction, and similar applicable app store (or platform) policies.
• You are solely responsible for (1) determining whether an end user of your Property or Advertisement qualifies as a “child” under the definitions and requirements of applicable laws; (2) taking the steps necessary to ensure that you do not initialize or use any AppLovin Software or technology in any way or otherwise use any aspect of the Services in connection with a “child” under applicable laws; and (3) ensuring that any Property or Advertisements (or the associated products or services) comply with all age-related laws, regulatory requirements, and applicable app store (or other platform) policies, including COPPA, laws of similar effect in any applicable jurisdiction, and other laws that may be enacted in the future.
